Rental Agreement – Terms & Conditions

This agreement is entered into between Diamond Car Rentals (Lessor) and the undersigned Lessee, subject to the following mutually accepted terms and conditions:

A) Return of Vehicle: The duration of this agreement is specified on the front page. Upon termination, the Lessee shall return and deliver the leased motor vehicle to the Lessor’s office without further reminder.

B) Prohibition of Abandonment: Abandonment of the car to third parties or leaving it insecure (unprotected on public streets) is strictly prohibited. If abandoned, the Lessee shall pay full indemnification for possible vehicle damages, lost business due to delay in resuming possession, and all towing/transportation expenses to return the vehicle to the Lessor’s office.

C) Late Delivery & Misappropriation: Failure to deliver the car within the defined term shall result in indemnification payments for lost usage/profits, and may subject the Lessee to legal prosecution for misappropriation.

D) Agreement Extension: Extensions to the rental duration are valid only upon explicit written agreement from the Lessor.

A) Calculation of Rental: Rental charges are calculated on a daily basis combined with kilometers driven, as recorded by the factory-installed odometer upon delivery and return.

B) Odometer Faults: Should the odometer fail through no fault of the Lessee, mileage charges will be estimated based on reported driving routes, but shall not be lower than the daily minimum rental pay specified.

C) Tampering: Any tampering with the vehicle’s odometer shall render the Lessee liable to criminal prosecution.

D) Fuel & Basic Maintenance: All operational expenses (gasoline, oil, etc.) during the lease are borne by the Lessee. The Lessee is obligated to monitor coolant levels, tire air pressure, and proper lubrication. The Lessee assumes full financial responsibility for damages resulting from failure to maintain these standards.

E) Fines & Legal Costs: The Lessee is fully responsible for all traffic fines, police regulation violations, and legal costs imposed by administrative or judicial authorities during the rental period.

The Lessee acknowledges taking delivery of the car after testing its operation and confirming that the steering, braking systems, lights, turn signals, and horn are in perfect working condition. The Lessee promises to return the vehicle in the exact same condition as received.

The Lessee is held responsible for any damage or injury to persons or property (inside or outside the vehicle) resulting from the car’s operation while in motion or stationary. The Lessee agrees to compensate the Lessor immediately for vehicle damage, excessive wear beyond normal usage, and non-usage loss due to accidents, irrespective of fault.

The Lessee must take all necessary precautions to prevent accidents or vehicle theft. The Lessee remains liable for damages caused to third parties or to the stolen car. In the event of theft, the Lessee must notify both the Police Authorities and the Lessor immediately.

In the event of an accident or mishap, the Lessee must notify the Lessor at once. The Lessee shall not admit liability, but must collect pertinent evidence (such as witness names, contact information, and accident details) and deliver it to the Lessor for further action.

The Lessor is not responsible or accountable for loss or damage to items left, stored, or transported in the vehicle by the Lessee or any third party, either prior to or following return. Furthermore, the Lessor is not liable for damages or losses sustained by the Lessee resulting from delays due to mechanical breakdowns.

The Lessee is not permitted to operate or park the vehicle in violation of local laws, administrative regulations, or the Road Traffic Code. The following acts are strictly prohibited:

  • Operation by any person without a valid driving license.
  • Operation by any person other than the declared Lessee/authorized drivers.
  • Operation under the influence of alcohol, narcotics, drugs, fatigue, or illness.
  • Carrying passengers or goods for commercial payment, or towing other vehicles/objects.
  • Subleasing or transferring the vehicle to any third party without explicit written consent from the Lessor.

The Lessee is not entitled to replace spare parts without prior written consent from the Lessor, except for minor breakdowns essential to continuous safe operation (such as replacing a faulty headlight bulb or a broken fan belt).

The leased vehicle is covered against Third Party Liabilities for property damage and personal injury according to statutory requirements. Third party insurance does not extend coverage to the driver or vehicle occupants unless additional specialized policies are signed through the care of the Lessor.

Guarantee: The Lessee pays a security sum upon agreement execution to ensure strict observance of these terms.

Private Solvency & Jurisdiction: The Lessee confirms holding sufficient private assets to satisfy any losses or damages incurred beyond the guarantee amount. Any legal disputes arising from this agreement shall be submitted to the exclusive competence of the Courts of Athens.
